Terms of Use
Plain terms for a free app made for families. Nothing here is designed to catch you out.
The short version.
Nepali Buddy is free and still early. Use it with your child however helps. Don't try to break it or pass it off as your own. We've written the lessons carefully, but this is a learning aid made by a small effort — not a school, a qualified teacher, or a guarantee that your child will end up fluent.
1. Who these terms are between
These terms are an agreement between you and FILL IN — your full legal name, an individual developer based in the United States who operates Nepali Buddy ("we", "us"). They cover the nepalibuddy.com website and the Nepali Buddy app for iPhone, iPad and the web.
By using Nepali Buddy you accept these terms. If you are using it with a child, you are accepting them on that child's behalf as their parent or guardian.
2. The app is free, and early
Nepali Buddy is free to use. There is no subscription, no payment screen, no locked lesson and no advertising. We are not obliged to keep it free forever, but if that ever changes we will say so clearly and in advance, and we will not retroactively lock content your family has already been using.
Nepali Buddy is in early access. The lesson library is still growing, some material is awaiting review by Nepali-speaking educators, and features may change or be removed between versions. You should expect rough edges.
3. What Nepali Buddy is not
This matters more than the usual boilerplate, so we will be specific. Nepali Buddy:
- is a practice aid, not a school curriculum, a course, or a qualification;
- does not assess, score or certify your child's pronunciation or handwriting;
- does not guarantee fluency, literacy or any particular outcome;
- is not a substitute for a teacher, a tutor, or — most of all — a Nepali-speaking family.
We have taken care with the Nepali in the app, and lessons are reviewed by named human editors before publication. Even so, language teaching involves judgement, regional variation and occasional error. If you spot something wrong, please tell us at hello@nepalibuddy.com — corrections from Nepali-speaking families are genuinely welcome and we would rather know.
4. Using it reasonably
Please do not:
- copy, redistribute or resell the lessons, recordings or artwork as your own;
- attempt to break into, overload or interfere with our servers or other people's use;
- reverse engineer the app except where the law expressly permits it;
- use Nepali Buddy for anything unlawful.
Beyond that, use it freely with your family. Using it in a classroom, a community Nepali school or a weekend language group is fine and encouraged — no permission needed.
5. Who owns what
The Nepali Buddy name, the mascot artwork, the lesson content, recordings and the software are owned by us or used with permission, and are protected by copyright. These terms give you permission to use the app; they do not transfer ownership of anything.
Nepali Buddy includes third-party open-source components, including typefaces licensed under the SIL Open Font License. Those remain under their own licences.
6. Availability
We run Nepali Buddy on a best-effort basis. The web version may be unavailable during maintenance, or because of a problem with our hosting. Downloaded lessons on iPhone and iPad keep working offline regardless. We may change, suspend or discontinue any part of the service, and we will give reasonable notice where we practically can.
7. Provided as-is
Nepali Buddy is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its content is complete or free of mistakes.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any right you have as a consumer that cannot be limited by law.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of your use of Nepali Buddy. Because Nepali Buddy is provided free of charge, our total liability to you for any claim relating to it will not exceed one hundred United States dollars (US$100).
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
9. Apple
If you download Nepali Buddy from the App Store, your use is also subject to Apple's own terms. Apple is not a party to this agreement and is not responsible for the app, its content, or any support for it. Apple has no obligation to furnish any maintenance or support services for Nepali Buddy. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Changes to these terms
We may update these terms as Nepali Buddy develops. The "last updated" date at the top of this page always reflects the current version. If a change materially affects your rights, we will highlight it here rather than changing the text quietly. Continuing to use the app after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the State of FILL IN — US state, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the courts located there, except where the law of your own country of residence gives you the right to bring a claim locally — in which case that right is preserved.
